The EB-2 NIW process (and how timing really works)

  1. Prepare the NIW strategy + evidence package
    Define the endeavor, choose the strongest theory under Dhanasar, and build exhibits that support each prong.
  2. File Form I-140 (EB-2 NIW petition)
    In NIW cases, the I-140 filing commonly establishes your priority date (your “place in line” for an immigrant visa number).
  3. Wait for visa availability (if required)
    Many applicants must wait until their priority date is current under the Visa Bulletin. USCIS updates which chart to use for I-485 filings each month (Final Action Dates vs Dates for Filing).
  4. Finish with Adjustment of Status (I-485) or consular processing
