O-1 Visa
The O-1 visa is designed for a person who has an "extraordinary ability" in the sciences, arts, education, business or athletics. Documentation showing national or international recognition will be required.
The O1A visa is for an individual who “has extraordinary ability in the sciences, arts, education, business or athletics which has been demonstrated by sustained national or international acclaim.”
O1B Visa. For an individual in a motion picture or TV production, the person must have “a demonstrated record of extraordinary achievement.
Documentation includes but is not limited to:
- Nationally or internationally recognized awards
- Proof of membership in an organization that requires outstanding achievement
- Published material in academic or trade publications
- Evidence that individual has judged the work of others in the field
- Original scientific or scholarly work of major significance in the individual's field
- Evidence that the individual has been employed in a critical position at an organization with a distinguished reputation
- Proof that the individual will receive a salary much higher than others in his or her field
- Proof that the individual in the arts is cast in the lead role of a production with a distinguished reputation
- Critical reviews
- Record of major commercial success
- Opinion letter from appropriate source if available
The O-1 visa is limited to a maximum duration of three years and the individual needs to have an employer willing to sponsor the petition.
