L1A Visa - Intracompany Transferee
The L1A is a non-immigrant visa designed to allow foreign corporations with a US base of operations or a US subsidiary or affiliate (or who wish to start a US base of operations) to transfer executive or management employees to the US. US corporations with foreign operations, subsidiaries or affiliates, also qualify.
The L1 may enter the US to continue to render his services to the same employer or a subsidiary or affiliate of that employer. The employer abroad or in the US may be the petitioner as long as they are qualified..
A qualifying organization is one that is a US or foreign organization that will be doing business in the US and abroad for at least the duration of the L1 visa. There is no requirement that the companies be involved in international trade nor do the companies have to be doing business with each other. For this reason a non-profit religious or cultural organizations may also utilize the L1 visa.
The prospective employee must have been employed by the company (including a subsidiary or affiliate) for at least a year in the last three and must be entering to perform work in an executive, managerial, or a position that requires "specialized knowledge" in the case of an L1B visa.
