Cap Exempt H1B Visas
Certain visas that are available under the H1B program are exempt from the yearly cap. Generally, current H1B visa holders seeking an extension or transfer are exempt from the annual cap.
Addtional categories that are exempt from the annual cap are:
Teachers and professors and others that are offered a job at an institution of higher learning
J-1 waiver recipients through the State 30 program
Current H1B visa holders transferring to a different employer
Spouses and children of current H1B visa holders are able to receive H4 visas without being effected by the cap.
