independent contractor or employee in a supernumerary position to avoid
a possible denial.

TN applications for citizens of Canada and citizens of Mexico require different procedures. The procedures for citizens of
Mexico are more detailed and restrictive than those for citizens of Canada.
TN Work Authorization Under the NAFTA
Under the North American Free Trade Agreement citizens of Canada and Mexico are able to enter the United States to work for US employers in a variety of specific professional positions that are listed in NAFTA. The status is available for up to three years and can be extended in three-year increments. Spouses and children are also eligible to enter in a TD status but are not eligible to work.
