EB-1 - Extraordinary Ability
An employer may petition for an employee who meets the definition of an alien with "extraordinary ability"without having to first complete the Labor Certification process. This advantage may save a great deal of time and allow the employee to begin work much sooner than employees that proceed through the standard Labor Certification process.
Extraordinarily ability may be demonstrated by sustained national or international acclaim using extensive documentation. A common example of acclaim that demonstrates"extraordinary ability" is receipt of an award such as the Nobel Prize. However, many other types of awards and recognition may be used to satisfy the burden of proof.
Individuals in the sciences, arts, education, business, and athletics may be eligible to pursue and EB-1 petition.
